An Abuja High Court has issued an interim injunction restraining the Minister of the Federal Capital Territory (FCT), Nyesom Wike, and other parties from selling or interfering with a disputed property in Abuja. The property in question is located at Plot No. 4411, Cadastral Zone A09, Guzape District.
Justice Mohammed Zubairu granted the order following an ex-parte motion moved by Reuben Atabo, SAN, counsel to the claimant, Nextdora Nigeria Limited. The motion, marked M/16807/2024, was filed on December 16, and its certified true copy was made available on Tuesday.
Justice Zubairu, a vacation judge, stated that the decision was made in the interest of justice and fair hearing.
“The interim order of injunction is to last for a few days, pending when all parties are served and appear before this court for the hearing of the motion on notice,” the judge said.
The court directed the defendants, including the FCT Minister, Federal Capital Development Authority (FCDA), and others, to refrain from trespassing on or developing the property. The injunction also bars them from assigning the property to a third party until the motion on notice is determined.
The case has been adjourned to December 30 for the hearing of the substantive suit. The claimant, Nextdora Nigeria Limited, seeks a declaration of its title to the property and further reliefs, including a permanent injunction to prevent the defendants from interfering with its ownership.
This legal action highlights the ongoing dispute over the Guzape District property and underscores the court’s role in ensuring justice and protecting property rights.
