The Court of Appeal on Thursday has quashed the judgement of the Delta State Election Tribunal that dismissed the petition of the Labour Party (LP) governorship candidate in Delta, Ken Pela against the victory of Governor Sheriff Oborevwori.
The Delta Tribunal had earlier dismissed Ken Pela and LP’s petition against Governor Sheriff on the premise that he abandoned his pre-hearing.
The LP candidate not satisfied by the ruling, appealed the judgement at the Court Of Appeal in Abuja.
The Appeal Court has now ordered a retrial of the petition, implying that Ken Pela will head back to the tribunal panel sitting at Delta to continue his case.
The nations electoral body, the Independent National Electoral Commission (INEC) had announced the candidate of the PDP, Sherrif Oborevwori the winner of the governorship election with a total of 360,234 votes to defeat his closest opponent, Ovie Omo-Agege of the All Progressive Party (APC) who scored 240,229 votes.
Ken Pela of the Labour Party came third with 48,027 votes, with Great Ogboru of the. All Progressive Grand Alliance coming fourth with 11,021 votes.
