UK to Fast-Track Deportation of Foreign Criminals Immediately After Sentencing

In a significant overhaul of its criminal justice and immigration policy, the United Kingdom has announced that foreign nationals convicted of crimes will soon face immediate deportation following sentencing.

According to the UK Government, this move aims to swiftly remove foreign offenders from British prisons, reduce costs for taxpayers, and enhance public safety.

Previously, most foreign offenders were deported after serving 50% of their prison terms. Starting in September, this threshold will be reduced to 30%. Once new legislation is enacted, deportation will take place immediately after sentencing for most determinate sentences.

Statistics show that almost 5,200 foreign offenders have been deported since July 2024 — a 14% increase compared to the previous year. Currently, foreign nationals account for approximately 12% of the UK prison population, with each prison place costing an average of £54,000 annually.

The new measure will exclude terrorists, murderers, and others serving life sentences, who will still be required to complete their full prison terms. Authorities will also maintain discretion in cases where offenders pose ongoing threats, such as risks to national security.

Lord Chancellor and Justice Secretary, Shabana Mahmood, emphasized the government’s firm stance, stating:

“This government is taking radical action to deport foreign criminals as part of our Plan for Change. Deportations are up under this government, and with this new law, they will happen earlier than ever before. Our message is clear: if you abuse our hospitality and break our laws, we will send you packing.”

Additional measures are also being developed to accelerate removals, including the creation of returns hubs, a new returns treaty with France to send back small boat arrivals, and tighter rules under Article 8 of the European Convention on Human Rights to facilitate deportations.

The proposed law, which requires parliamentary approval, will apply to all foreign offenders currently in custody as well as those convicted in the future.
