Stan Alieke, the lawyer representing Nigerian singer Speed Darlington, has called out the illegal practice of landlords unilaterally increasing rent without consulting their tenants. Alieke emphasized that such actions violate tenancy laws and established court rulings in Nigeria.
Speaking on the matter, Alieke stated, “It is unlawful and illegal for a landlord to unilaterally increase rent without first consulting or renegotiating the price with the tenant.” He noted that numerous court decisions across the country have reinforced this position, highlighting the legal obligation of landlords to engage tenants before implementing any changes to rental terms.
Nigerian tenancy laws, such as the Lagos State Tenancy Law of 2011, mandate that rent adjustments must be agreed upon by both parties to ensure fairness and transparency. Unilateral increases, according to Alieke, breach tenancy agreements and infringe on tenants’ rights.
Experts in real estate law advise tenants to review their agreements and seek legal counsel when faced with unauthorized rent hikes. “Tenants should not feel compelled to accept arbitrary increases. Open dialogue with landlords and legal action, if necessary, can help uphold their rights,” Alieke added.
This issue underscores the importance of mutual respect and communication in landlord-tenant relationships. While landlords have the right to adjust rent, it must be done legally and with the tenant’s consent.
