The Court of Appeal in Abuja has overturned the suspension of Mr. Muhuyi Magaji, Chairman of the Kano State Public Complaints and Anti-Corruption Commission (PCACC), by the Code of Conduct Tribunal (CCT). The three-member panel of justices, led by Justice Umaru Fadawu, ruled that the CCT’s order was prejudicial and denied Magaji a fair hearing.
The CCT had suspended Magaji on April 4, following allegations of misconduct preferred against him by the Code of Conduct Bureau (CCB). However, Magaji’s counsel, Adeola Adedipe, SAN, argued that the CCT erred in law by denying his client a right to fair trial and fair hearing.
The Court of Appeal agreed with Adedipe’s arguments and set aside the CCT’s order. The court also ordered that the matter be re-assigned to another panel of the CCT. This decision is a significant development in the case, which has been ongoing since November 2023, when Magaji was arraigned before the CCT on a 10-count charge bordering on alleged conflict of interest, false declaration of assets, among others.
