The Nigerian Bar Association (NBA) has strongly criticized the recent controversial decision made by Governor Ademola Adeleke to remove the Chief Judge of Osun State, Justice Adepele Ojo. In a statement released by the NBA’s National Publicity Secretary, Mr. Akorede Lawal, yesterday, the association expressed its vehement opposition to the governor’s action and stated that it will not recognize Justice Olayinka Afolabi, the Acting Chief Judge appointed by the governor.
Governor Adeleke’s decision to remove Justice Ojo has sparked widespread concern among legal practitioners and citizens alike. The NBA, as a body representing the interests of legal professionals, has condemned this move, emphasizing the importance of adhering to due process and maintaining the independence of the judiciary.
According to the NBA, removal of a Chief Judge should be executed in accordance with constitutional provisions and due process. The association highlighted that a Chief Judge can only be removed through recommendations made by the National Judicial Council (NJC) followed by confirmation by the State House of Assembly. Failure to adhere to these guidelines undermines the integrity of the judicial system.
The NBA’s statement also expressed concerns regarding the appointment of Justice Afolabi as the Acting Chief Judge, asserting that it cannot recognize his authority. The association believes that his appointment lacks legitimacy, as it was made without due process and without the approval of the NJC and State House of Assembly.
The NBA strongly called on Governor Adeleke to reinstate Justice Ojo as the Chief Judge of Osun State, as per constitutional provisions. Failure to do so, the association warned, could have far-reaching consequences on the independence of the judiciary and the rule of law in the state.
Legal experts and human rights activists have echoed the NBA’s sentiments, calling the governor’s actions a dangerous precedent that sets a worrisome tone for the judiciary’s independence in Nigeria. They argue that the removal and appointment of a Chief Judge should not be subject to the whims of political actors, but rather should follow established constitutional procedures to ensure the preservation of the rule of law.
As the legal community and concerned citizenry await Governor Adeleke’s response, the NBA remains committed to defending the integrity of the judiciary and upholding the principles of justice. The association vows to explore all necessary legal avenues and use its collective power to ensure that the constitutional provisions are upheld and the independence of the judiciary is maintained in Osun State.
