The National/State Assembly Election Petitions Tribunal sitting in Benin, on Monday upheld the election of former APC Chairman, Adams Oshiomhole as Senator representing Edo North Senatorial District.
The Tribunal dismissed the petition of Senator Francis Alimikhena of the Peoples Democratic Party (PDP), who is challenging Oshiomhole’s declaration by the Independent National Electoral Commission (INEC).
Alimikhena had filed a petition at the Tribunal seeking to upturn the result announced by INEC in a suit numbered EPT/ED/SEN/02/2023.
The three-man tribunal headed by Justice O.A. Chuioke, dismissed Senator Alimikhena’s petition for lacking in merit.
The unanimous judgement read on behalf of the tribunal chairman, Justice Chuioke by Justice Alero Akeredolu, said that the petitioners failed woefully to proved their case, adding that they cannot rely on weakness or strength of the respondents to prove their cases against Comrade Oshiomhole.
Justice Akeredolu also held that the petitioners also failed to tender before the tribunal any relevant document to prove a case of non -compliance as contained in their petitions.
