
The (ICPC) has filed a counter-affidavit opposing a fresh bail application submitted by former Kaduna State Governor, , in an ongoing case before the Kaduna State High Court.
At the resumed hearing on Tuesday, counsel to the defendant, Mr. Ubong Akpang, notified the court of the new bail application, stressing that it directly concerns his client’s liberty. He stated that all required legal processes had been duly filed and served, and expressed readiness to proceed with the hearing.
However, ICPC counsel, Mr. Ibrahim Mukhtar, told the court that he had only just been served with the defendant’s further affidavit supporting the application. He requested additional time to study the new filings.
In view of this development, the presiding judge, Justice D.H. Khobo, adjourned the matter to May 13, 2026, for the hearing of the bail application.
The latest application follows an earlier ruling in which the court denied bail to El-Rufai. In that decision, Justice Khobo held that the defendant failed to submit a further affidavit to counter the ICPC’s claims, which introduced new and significant facts.
Among the issues raised by the prosecution were concerns over potential flight risk due to the defendant’s influence and resources, allegations of obstruction during a lawful arrest attempt at the , and refusal to surrender travel documents and electronic devices for investigation.
The ICPC also expressed fears that the defendant could interfere with witnesses and tamper with evidence, particularly as some suspects in the case are still at large.
In rejecting the initial bail request, the court emphasized that bail is discretionary and must align with the interests of justice. Justice Khobo noted that El-Rufai’s status could potentially hinder ongoing investigations and that his failure to contest key allegations effectively amounted to an admission.
The court also dismissed health-related claims presented by the defence, citing lack of supporting evidence.
Consequently, the court ordered that the former governor remain in ICPC custody pending the commencement of trial and directed that proceedings be expedited.
Despite this setback, the defence team filed a fresh bail application, prompting the ICPC’s latest opposition.
