Court Reaffirms Philip Shaibu’s Reinstatement as Edo Deputy Governor, Fines Obaseki-Led Government N400,000

The Federal High Court in Abuja has reaffirmed Rt. Hon. Comrade Philip Shaibu’s reinstatement as Edo State Deputy Governor on Tuesday.

Justice James Omotosho dismissed the Obaseki-led Edo State government and state House of Assembly’s stay of execution application.

Dissatisfied with the appellants’ application, Justice Omotosho stated, “I cannot grant the application as I earlier gave a judgment reinstating Shaibu.” He dismissed the application with a ₦200,000 fine against each appellant.

In July 2024, Justice Omotosho reinstated Shaibu as Deputy Governor, months after his impeachment by the state assembly. The court declared the impeachment “illegal, unconstitutional, null, and void” due to gross violations of sections 188 and 35 of the 1999 Constitution.

The judge held, “The impeachment was in gross violation of the Constitution.” Shaibu’s salaries and allowances from April were ordered to be paid. The court issued a perpetual injunction restraining Governor Godwin Obaseki and the Edo State House of Assembly from stopping Shaibu from performing his duties.

Justice Omotosho also ordered Inspector General of Police Kayode Egbetokun to restore Shaibu’s security details, which the IGP complied with.

The ruling reaffirms Shaibu’s position as Deputy Governor, overturning his impeachment. The court’s decision emphasizes the importance of constitutional adherence in governance.

The Edo State government and House of Assembly’s appeal was rejected, solidifying Shaibu’s reinstatement. The fine imposed on the appellants underscores the court’s commitment to upholding the law.
