Federal High Court Orders Emir Sanusi’s Eviction from Palace, State Court Counters Order

A Federal High Court in Kano has ordered the eviction of Emir Muhammadu Sanusi II from the Kofar Kudu Palace, but a State High Court has countered the order, restraining the police and other security agencies from carrying out the eviction.

The Federal High Court, presided over by Justice S.A. Amobeda, granted an ex-parte motion filed by the deposed Emir of Kano, Aminu Bayero, ordering the police to ensure all rights and privileges due to Bayero are given to him. The court also restrained the Nigeria Police Force and other respondents from denying Bayero the use of his official residence at the Emir’s Palace and enjoyment of all rights and privileges accrued to him as the Emir of Kano.

However, a State High Court, presided over by Justice Amina Adamu Aliyu, granted an interim injunction restraining the police, State Security Service, and Nigerian military from evicting Sanusi from the palace. The court also restrained the security agencies from arresting or harassing Sanusi and his kingmakers.

The development comes amid a tussle between Sanusi and Bayero over the rightful Emir of Kano, following the repeal of the law that led to the creation of four more emirates in the state and the appointment of Bayero as Emir of Kano.

The case has been adjourned to June 4 for hearing at the Federal High Court, while the State High Court adjourned the case to June 13 for hearing.
