A High Court sitting in Katsina State has struck out a suit involving internal disputes within the African Democratic Congress (ADC), citing lack of jurisdiction.
The ruling, delivered on April 14, 2026, by Hon. Justice A.K. Tukur at the Dutsin-Ma Judicial Division, followed a Motion Ex-Parte filed by the applicant, Alhaji Musa Usman Wamba, the State Chairman of the ADC in Katsina.
Wamba had approached the court seeking to vacate an earlier interim order issued on April 7, 2026, against the defendants, which include Lawan Batagarawa, Babangida Ibrahim Mahuta, the African Democratic Congress, and the Independent National Electoral Commission (INEC).
In his decision, Justice Tukur held that the matter before the court bordered on the internal affairs of a political party. He referenced Section 83(5) of the Electoral Act, which bars courts from entertaining cases relating to the internal affairs of political parties.
The court further emphasized that the law prohibits the granting of interim or temporary orders in such matters.
Consequently, the judge vacated the earlier ex-parte order issued on April 7, 2026, and struck out the suit entirely for want of jurisdiction.
The ruling effectively ends the legal action, leaving the parties to resolve their disputes outside the court system.
