Governor Fubara has withdrawn his appeal at the Supreme Court against the judgments of the Federal High Court and Court of Appeal. These judgments had favored the Pro-Wike lawmakers and indicted Fubara for the burning of the Rivers State House of Assembly.
The judgments also ordered Fubara to re-present the 2024 budget of Rivers State to the Rivers State House of Assembly, led by Pro-Wike Speaker Martins Amaewhule. By withdrawing his appeal, Fubara has effectively accepted the resolution of the Federal High Court Abuja and the judgment of the Court of Appeal, which declared the Rivers State budget of 2024 illegal.
Notably, Fubara had not filed a counter to this suit at the trial court, and the Court of Appeal had ruled that he could not institute an appeal on a matter he did not challenge at the trial court. It is likely that the Supreme Court would have reached a similar decision, had Fubara not withdrawn his appeal.
Meanwhile, the Supreme Court is set to hear other appeals related to Rivers State today.
