Kano State Government Ordered to Pay N10 Million in Damages for Breaching Deposed Emir Bayero’s Fundamental Rights

A Federal High Court in Kano has ordered the Kano State Government to pay N10 million in compensation for breaching Aminu Bayero’s fundamental human rights.

Justice Simon Amobeda while delivering the judgment, described the Governor’s order for Aminu Bayero’s arrest as “unlawful” and forcing him into house arrest.

The respondents, including the Attorney General and security agencies, were restrained from further interfering with Aminu Bayero’s rights.

The judgment reads, “That, the act of the Governor of Kano State…is a threatened breach of the fundamental right to Liberty…guaranteed under Section 35(1) of the Constitution…1999 (as altered).

“That, the act…constitutes a flagrant violation of his fundamental right to freedom of movement…guaranteed under Section 41(1) of the Constitution…1999 (as altered).

“That the 2nd, 3rd, 4th and 5th Respondents…are restrained from arresting, detaining, threatening…the Applicant or further interfering with the Applicant’s fundamental rights.

“That the 2nd Respondent and the Government of Kano State shall pay…N10,000,000.00…for the breach…of the Applicants fundamental rights…guaranteed under the Constitution…1999 (as altered). “The prayer…is refused, the amount…not been specifically pleaded and strictly proved,” Justice Amobeda ordered.
