University College Hospital (UCH), located in Ibadan, has taken legal action against the chief of Ijesaland, Olatunde Oginni, over an alleged breach of contract. UCH is also demanding the sum of N250,000,000 and the immediate termination of the contract with De Executive Suites and Oginni as the promoter.
Documents filed by UCH’s legal counsel, Olaniyi Akin, claim that Oginni violated the partnership agreement for the completion, operation, and transfer of the University College Hospital Guest House. The hospital is seeking a declaration that Oginni is indeed in breach of the agreement, which was signed on March 1, 2021.
UCH is also requesting a declaration that the termination of the partnership relationship between the two parties, as stated in a letter sent to Oginni on March 1, 2023, is valid, legal, enforceable, and in accordance with the agreement’s provisions. The hospital seeks an immediate order to terminate the partnership due to Oginni’s continuous and flagrant breach of the partnership agreement.
Furthermore, UCH is claiming the sum of N250,000,000.00 as special and general damages against Oginni, his agents, servants, or anyone claiming on their behalf for breaching the partnership agreement. The hospital is also seeking a perpetual injunction to restrain Oginni, his agents, servants, or anyone associated with them from continuing the operations and management of the guest house as stated in the partnership agreement.
The case will be heard in court and both parties will have the opportunity to present their arguments and evidence. The outcome of the legal proceedings will determine the future of the partnership between UCH and De Executive Suites, along with the liability for damages as claimed by the hospital.
