Court of Appeal Halts Sanusi’s Reinstatement as Emir of Kano Pending Supreme Court Decision

The legal proceedings concerning the Kano Emirate have undergone significant developments, particularly regarding the status of Muhammadu Sanusi II as the Emir of Kano. On March 14, 2025, the Court of Appeal in Abuja issued an injunction halting the enforcement of its earlier judgment that had favored Sanusi’s reinstatement. This decision is pending the outcome of an appeal currently before the Supreme Court.

Background of the Dispute

In 2020, Muhammadu Sanusi II was deposed as the Emir of Kano by the then-Governor Abdullahi Ganduje, who enacted a law dividing the Kano Emirate into five separate entities. This action led to the appointment of Aminu Ado Bayero as the 15th Emir of Kano. However, on May 23, 2024, the Kano State House of Assembly passed the Kano State Emirate Council (Repeal) Law 2024, which was promptly signed by Governor Abba Yusuf. This law dissolved the newly created emirates and reinstated Sanusi as the 16th Emir of Kano.

Legal Challenges and Court Rulings

The reinstatement of Sanusi faced immediate legal challenges. A titleholder in the Kano Emirate, Aminu Babba Dan’agundi, filed a suit challenging the new law and Sanusi’s reinstatement. On June 20, 2024, Justice Abubakar Liman of the Federal High Court in Kano granted an interim injunction restraining the state government from implementing the new emirate law, effectively halting Sanusi’s reinstatement.

Subsequently, on January 10, 2025, the Kano Division of the Court of Appeal vacated the High Court’s order that had nullified Sanusi’s reappointment. The appellate court held that the Federal High Court lacked jurisdiction over chieftaincy matters, which are within the purview of state high courts. This decision effectively reinstated Sanusi as the Emir of Kano.

Current Status and Implications

The recent injunction by the Court of Appeal to halt the enforcement of its earlier judgment means that Sanusi’s reinstatement is on hold pending the Supreme Court’s decision. This legal uncertainty affects the traditional institution in Kano State, as the position of the Emir remains contested. The outcome of the Supreme Court appeal will be pivotal in determining the future leadership of the Kano Emirate.
